WAIVERS and POLICIES
ELITE MADNESSS 617 GUIDELINES AND POLICES
Beginning on April 1st, 2021, a new cancellation policy will be enforced.
Sessions must be paid for by the Sunday of every week.
Sessions must be cancelled or rescheduled no less than 12 hours before the session. If you cancel after the 12-hour deadline, your payment for the session will be non-refundable and non-transferable.
If you arrive after your start time, it is not guaranteed that you will receive your full 30-minute session. Elite Madness 617 will do its best to accommodate. But due to strict scheduling it may not always be possible.
WAIVER AND RELEASE OF LIABILITY
In consideration of the potential risks of injury associated with participating in this training, and as a condition of my participation, I at this moment agree to the following:
1. Release of Liability
I, for myself, my heirs, executors, administrators, assigns, or personal representatives, voluntarily waive and release all claims against Delroy McDonald of Elite Madness 617 (located at 3463 El Cajon Blvd, San Diego, CA, 92104) and any affiliated persons or entities, including staff, volunteers, and representatives, for any injury, illness, or loss arising out of my or my child’s participation in this activity, including travel to and from events.
2. Assumption of Risks
I acknowledge that participation in this activity is voluntary and carries potential risks, including physical or psychological injury, pain, disability, economic or emotional loss, and death. I assume all risks, known and unknown, associated with this activity.
3. Indemnification
I agree to indemnify and hold harmless Delroy McDonald of Elite Madness 617 against any claims, damages, compensation, or expenses, including attorney’s fees, arising from claims related to my or my child’s participation in this activity.
4. Acknowledgment of Responsibility
I understand that Elite Madness 617, its affiliates, managers, agents, and volunteers are not liable for errors, omissions, or actions of other entities involved in event coordination.
5. Acknowledgment of Risks
I recognize that participation in this activity may involve risks due to terrain, weather, hydration, equipment, and actions of others, including participants, spectators, and event staff. I fully accept these risks.
6. Acknowledgment of Waiver
I have read and understand this waiver and release of liability, which I sign voluntarily, waiving any rights to bring legal action against Elite Madness 617 for personal injury or property damage.
7. Medical Responsibility
In case of injury, I understand that I am financially responsible for any medical expenses incurred and acknowledge that I should carry my own health insurance.
8. Damage Responsibility
I agree to be liable for any damages to equipment or facilities resulting from my or my child’s negligent or reckless actions.
Coronavirus/COVID-19 Acknowledgment
I acknowledge the risks associated with COVID-19 and the measures put in place by Elite Madness 617 to reduce its spread.
I understand that Elite Madness 617 cannot guarantee protection from COVID-19 and assume the risk of exposure.
I attest that:
I am not experiencing symptoms of COVID-19.
I am not aware of recent exposure to COVID-19.
I am following CDC guidelines to reduce my exposure.
I agree to hold Elite Madness 617 harmless for any COVID-19-related claims.
Parent/Guardian Waiver for Minors
If the participant is under 18, this waiver must be signed by a parent or guardian:
“I certify that I am the parent or guardian of [ ] and consent to the terms of this.”
